This Privacy Statement applies to all business activities of Andrew
J Knight Pty Limited trading as winecard (A.C.N. 096 428 732).
Winecard recognizes the importance to our card holders and retailers of the discreet and confidential handling of their personal information. It is winecard’s policy to comply with the requirements of the Privacy Act 1988 and the National Privacy Principles contained in that Act in all activities of winecard involving the collection, use, disclosure and handling of personal information.
Primary business of winecard
Andrew J Knight Pty Limited which trades as winecard collects card
holder information via the winecard website. It also collects card holder data from
retailers regarding the sales of winecards and other products. This
customer data is subsequently used by winecard to assist participating
retailers
in running their business.
Card holders are defined as those individuals who have purchased or
been given a winecard. In activating their winecard, card holders
acknowledge that their nickname, type of card held, date joined and
top rated wines may be disclosed on the winecard website unless they
elect to remain anonymous.
In using their winecard at a participating retail outlet, card holders acknowledge that their name and the location where they acquired their first winecard can be provided to the retailer. Card holders also acknowledge that they
may receive email communications via the winecard website from
retailers where they have used their winecard. Card holders email
addresses will not be disclosed to retailers. Card holders can elect at
anytime after using their winecard at a retailer not to receive emails
from that retailer.
All other information is kept within our database and is not disclosed.
Retailers are defined as any place that sells or accepts winecard.
Retailers details are collected via the winecard website, and displayed on the winecard website for the purpose of promoting their business. Details of a retailers sales, wine reviews and cellar door reviews will be kept confidential and can only be accessed by the aforementioned retailer
Winecard will collect personal information by lawful and fair means and not in an unreasonably intrusive way.
Winecard will make known the purpose for which it is collecting personal information and will collect personal information concerning an individual only from that individual and the retailer where they have acquired or used their winecard.
Winecard will not use personal information concerning an individual
for a
purpose other than the primary purpose for which it was collected as
stated in the relevant "Definitions and Recitals" in regards to
business nature, unless winecard has obtained the consent of the
individual
to the use of that information for a secondary use, such as direct
marketing.
If it is not practicable to obtain the individual's consent and the individual has made known to winecard the individual's desire not to receive any further direct marketing communications, winecard will cease any direct marketing communications to the individual.
Personal information collected and/or stored is never used for or disclosed to any third party with the exclusion of the disclosure of such customer information as outlined above to winecard retailers.
Winecard will take all reasonable steps to ensure that personal information that it holds is accurate, complete and up-to-date.
Winecard has in place a full time IT team who maintain our data security systems, networks and procedures. In particular all winecard databases are protected by secure network links, firewalls, password protection and virus protection.
All winecard staff are required to sign confidentiality clauses as part of their employment agreement, such confidentiality clauses have termination of employment confidentiality survival clauses.
On request by individuals, winecard will make known to those individuals the types of personal information it holds, the purpose for which it is held and how winecard collects, holds and uses that information.
On request by an individual, but subject to the exceptions prescribed by the National Privacy Principles, winecard will provide the individual with access to their personal information and will allow that individual a reasonable opportunity to correct any inaccuracies or out-of-date information. Confirmation of any changes to customer information will be provided as previously outlined within this document.
A request for access to the personal information held by winecard concerning an individual can be made by that individual to winecard in writing by post or via the winecard website. A fee may apply in some circumstances.
winecard will not use tax file numbers or other government-issued identifiers, to identify a record of personal information relating to an individual.
