"Card" means your winecard.
"Card holder" means the person who has received a winecard.
"Participating retailers" means a person or organisation which has agreed to offer certain benefits to card holders.
"Winecard" , "we" or "us" means all business activities of Andrew
J Knight Pty Limited trading as winecard (A.C.N. 096 428 732).
"Winecard system" means your purchase or acceptance on a winecard and or the subsiquent use of your wine card winecard to receive benefits from participation retailers.
The winecard system
The system is operated by Winecard in conjunction with participating retailers.
Participation in the winecard system is offered to card holders at the discretion of Winecard
We may change these Terms and Conditions at any time without prior notice and We reserve the right to suspend or terminate the system at any time without prior notice.
Amendments to these terms and conditions will be posted on the Winecard website.
Your participation in the winecard system and your use of the card is subject to these Terms and Conditions (as varied from time to time).
Your participation in the winecard system will be taken as your acceptance of these Terms and Conditions.
We may terminate your participation in the winecard system without notice and for any reason.
The benefits
The benefits available card holders are listed on the Winecard website.
All benefits are subject to availability and other terms and conditions which may be imposed by participating retailers as listed on the Winecard website.
The benefits are available to winecard card holders only and cannot be sold, transferred, assigned or otherwise dealt with except with the consent of Winecard and the relevant participating retailer.
To claim a benefit, you must communicate to the participating retailer that you are a winecard card holder and that you wish to obtain a benefit under the winecard system:
If you contact the participating retailer by telephone you must notify the participating retailer that you are a winecard card holder.
In a face-to-face transaction you must present your winecard.
In a web-based transaction you must enter your card number or any other method of identification that may be required by the participating retailer.
We take all reasonable care to ensure that information We publish in relation to the winecard system is accurate but do not accept any liability relating to information provided by third parties. All descriptions of benefits we publish are based on information supplied by participating retailers
Participating retailers and transactions
Under the system, we arrange for participating retailers to offer certain benefits to winecard cardholders. Participating retailers are not the agents of the Winecard and have no authority, express or implied, to bind the Winecard or to make any representations, warranties or statements on the Winecard's behalf.
We are not a party to any transactions entered into between a card holder and a participating retailer.
We are not liable in any way for:
Any use of your details or your winecard by a person without your consent;
any failure by you to notify a participating retailer that you are seeking a benefit under the system when purchasing goods or services;
a participating retailer not offering or making available a benefit for any reason;
a failure by a participating retailer to comply with the terms of any transaction you enter into with the participating retailer;
the suspension and/or termination of the winecard system;
any delay in getting a replacement winecard to you.
Any liability for the condition, suitability, quality, fitness or safety or warranty as to the condition, suitability, quality, fitness or safety of any goods or services supplied under the system to you by a participating retailer is excluded to the fullest extent permitted by law.
Any liability of Winecard for breach of a warranty implied by law is limited to supplying or paying the cost of supplying the goods or services again or repairing, or paying the cost of repairing the goods, at the Winecard's option.
Any liability relating to the payment of tax, including GST, which arises from your participation in the system by virtue of your purchasing any goods or services from a participating retailer, is your responsibility.
Participating retailers may forward your name, email address and phone number to winecard when you purchase or accept a complimentary winecard.

You should refer to participating retailers for a copy of their privacy policy and for information on how they handle your personal information.
